    Jens Spahn<\/a> became a father through surrogacy in the United States<\/a>, but what should have been one of the happiest moments of his life quickly turned into a political crisis. Within days, the senior German politician resigned as parliamentary leader of the CDU\/CSU.<\/p>\n\n\n\n\n\n

    Jens Spahn and his husband, journalist Daniel Funke<\/a>, recently welcomed a child through a gestational surrogacy<\/a> journey in the United States.<\/p>\n\n\n\n

    Almost immediately, however, the news sparked a nationwide debate about surrogacy, political consistency, and the right to build a family.<\/p>\n\n\n\n

    The reason was straightforward. Surrogacy is prohibited in Germany, and Spahn’s political party, the Christian Democratic Union (CDU)<\/a>, had recently reaffirmed its opposition to legalizing the practice.<\/p>\n\n\n\n

    Spahn himself had previously expressed strong reservations about surrogacy as a form of assisted reproduction (A.R.T.)<\/a>.<\/p>\n\n\n\n

    The criticism wasn’t just about the fact that Spahn became a father through surrogacy.<\/p>\n\n\n\n

    The controversy centered on the actual contradiction between his personal decision to pursue surrogacy abroad and the official position of the party he represented. According to many German politicians and commentators, Spahn privately benefited from a reproductive option that he continued to oppose politically at home.<\/p>\n\n\n\n

    As a result, he faced accusations of inconsistency and hypocrisy, including from within the CDU itself.<\/p>\n\n\n\n

    Under growing political pressure from Chancellor Friedrich Merz, Jens Spahn announced his resignation as leader of the CDU\/CSU parliamentary group on July 18, 2026. He was not dismissed and did not lose his seat in the Bundestag. He stepped down only from his leadership position.<\/p>\n\n\n\n

    The CDU\/CSU later nominated Thorsten Frei, a close ally of Chancellor Merz<\/a>, to succeed him.<\/p>\n\n\n\n\n\n

    Surrogacy in Germany<\/a> is not legal.<\/p>\n\n\n\n

    German law prohibits physicians and intermediaries from participating in surrogacy arrangements within the country.<\/p>\n\n\n\n

    That doesn’t mean, however, that it’s illegal for German citizens to raise a child born through surrogacy abroad. Families who pursue international surrogacy<\/a> often face complex legal issues involving parentage, citizenship, and the recognition of foreign birth certificates<\/a>.<\/p>\n\n\n\n

    The Spahn case once again demonstrates that banning surrogacy in Germany has not eliminated the practice. Instead, it encourages intended parents to build their families in countries where surrogacy is legal and properly regulated.<\/p>\n\n\n\n\n\n

    The case raises an important question.<\/p>\n\n\n\n

    Should a politician have to give up a successful career because of the way they chose to build their family?<\/p>\n\n\n\n

    On one hand, surrogacy is a deeply personal decision rooted in the desire to become a parent. On the other hand, public officials are often judged not only by their policies but also by whether their personal choices align with the political positions they advocate.<\/p>\n\n\n\n

    In his resignation letter, Spahn wrote: “Over the past few days, I have realized that my personal happiness, building a family with my husband and welcoming our son, is incompatible with my political office.”<\/p>\n\n\n\n

    The most controversial aspect of the story is not that Jens Spahn and his husband became parents. Rather, it is that they pursued abroad an option their own political party continues to oppose within Germany.<\/p>\n\n\n\n

    The Spahn case highlights one of the greatest limitations of absolute legal bans.<\/p>\n\n\n\n

    The desire to become a parent does not disappear simply because a law suddenly says so. People who cannot have children naturally will continue searching for other paths, often by traveling abroad.<\/p>\n\n\n\n

    As debates over surrogacy continue across much of the European Union, perhaps the conversation should focus less on moral condemnation and more on creating legal frameworks that protect everyone involved: intended parents, the gestational surrogate, and above all, the best interests of the child<\/a>.<\/p>\n\n\n\n\n\n

    Jens Spahn’s resignation represents far more than an internal political dispute in Germany.<\/p>\n\n\n\n

    It shows how deeply surrogacy continues to divide Europe and how difficult it can be to maintain an uncompromising ideological position when the issue becomes part of someone’s personal life.<\/p>\n\n\n\n

    Spahn did not have to give up his family, nor did he commit a crime by becoming a father through a legal surrogacy journey in the United States. What he ultimately gave up was one of the most influential political positions in Germany because his personal decision was viewed as incompatible with his party’s public stance.<\/p>\n\n\n\n

    The joy of welcoming a child became a political controversy shaped by broader ideological debates, including civil rights, family rights and discrimination against LGBTQ+<\/a> families.<\/p>\n\n\n\n

    Perhaps the most important question is not whether Jens Spahn acted consistently. Instead, we should ask whether a modern society can truly address the desire to build a family through prohibitions, public condemnation and forced resignations alone.<\/p>\n\n\n\n
