Greece

Surrogacy Greece has had its own surrogacy legislation since 2002. Since 2014, access to the procedure has also been granted to citizens from other countries all over the word, without the need to reside there. Greece's membership to the Schengen area has made it the preferred surrogacy journey of citizens from various parts of Europe due to the absence of borders to cross upon return to the country of origin. The surrogacy procedure in Greece involves a judicial process before the medical and in vitro fertilization parts begin

Definition of surrogacy program

A surrogacy program is a set of medical and legal procedures whose ultimate goal is to have a child with an alternative to natural conception. The parties involved in the procedure are: the intended parents (or parent in the case of single individuals), an assisted reproductive clinic and a foreign agency or other equivalent entity capable of filling the needs related to egg donation and gestational carrier. An attorney experienced in the applicable law of the country in which the program takes place should be considered a key part of the process

Surrogacy Greece: program costs

There is no single cost that applies to every case. In fact, the price is closely related to certain variables such as whether an egg donation is needed, the type of program requested from the assisted reproduction clinic (which translates into the number of embryo transfers guaranteed. There can be one, two, three or unlimited attempts until pregnancy is achieved). In the case of single women, sperm donation is also required. Having clarified all possible variables, an estimate based on the case histories we have had allows us to say that the average price today for a guaranteed set-price program, (with no extra costs, including unlimited transfers, egg donor, gestational surrogate and legal support) is €85,000. In the case of am IVF program with one in vitro fertilization and up to 3 embryo transfers, the total cost drops to €75,000.

Legislation in Greece

Legislation in Greece regarding surrogacy should be considered relatively recent even though it has been available to Greek citizens for decades now. This model has been structured by a ruling which authorizes the surrogacy program and recognizes legal parentage to the intended parents, before the medical part has been performed. This ruling binds the surrogate mother to certain contractually established obligations. In fact, authorization to proceed is issued upon written agreement with the surrogate mother. This agreement must not constitute a financial benefit to the surrogate mother. She will, however, be reimbursed for all expenses incurred in the continuation of the program until the birth of the child. This includes any expenses arising from the delivery, such as a cesarean section or hospitalization. The law regulating surrogacy in Greece also requires that compensation be paid to the surrogate mother for the inconvenience and lack of earnings resulting from any loss of work

Intended Parent requirements

The legal procedure basically begins with a judgment recognizing the legal relationship between the child and the intended parent(s) prior to the initiation of the medical part. There are certain mandatory requirements for admission to the procedure, including proving that the intended mother is under 53 years of age. She must provide certification stating that she is unable to become pregnant or would sustain serious health risks from becoming pregnant and carrying a pregnancy to term. On the other hand, bringing one's own genetic material isn’t required for access to the procedure, but case-law has shown that it is clearly preferable, in the case of a heterosexual couple, for the intended father to be able to use his own semen

Birth Certificate

The birth certificate will bear the names of both parents (or the name of the mother in the case of a single woman)
