Definition of surrogacy program

A surrogacy program is a set of medical and legal procedures whose ultimate goal is to have a child with an alternative to natural conception. The parties involved in the procedure are: the intended parents (or parent in the case of single individuals), an assisted reproductive clinic and a foreign agency or other equivalent entity capable of filling the needs related to egg donation and gestational carrier. An attorney experienced in the applicable law of the country in which the program takes place should be considered a key part of the process

Current events: Russia between surrogacy and war

In some respects, surrogacy Russia has seen an increased influx of European citizens in recent times due to its proximity to the home countries of most of the intended parents who choose this country for having a child. Another factor has been the growing distrust of cheaper destinations such as Ukraine due to controversy surrounding the exploitation of surrogate mothers. In February 2022, Russia Russia began an armed attack on Ukraine, which would turn out to be the first in a long conflict. This circumstance obviously had consequences for the country's political stability, not least because of the sanctions imposed by Europe on the incumbent government. Legislation in Russia

The process is governed by the combination of various laws including the Family Code of the Russian Federation, the Federal Health Law, and a series of ordinances that include strict requirements for surrogate mothers, among others. Access to surrogacy is established for heterosexual couples and single women. By this reasoning, single individuals and same-sex couples are excluded. However, a recent trend of some Russian courts has focused on recognizing the right to parenthood to single men, in accordance with the principle of equality, leading to registration of the birth of their child at the Civil Status Registration Office, located at the same city, where the baby was born. In this case the gestational surrogate will appear on the birth certificate, but without claiming any rights to the child (N.B. this variant on the procedure remains without certain legal protection for singles). In the case of heterosexual couples, on the other hand, there will be no mention of the surrogate mother, only the names of the would-be parents will appear. Putin bans surrogacy for foreigners

The Russian President Vladimir Putin has passed a law banning foreigners from accessing surrogacy in Russia. The law was published in the"official legal information portal" (equivalent to United States Statutes at Large in the U.S.) detailing the new regulations. The technique remains available to Russian citizens who cannot conceive naturally for medical reasons as well as those cases in which a Russian citizen is united in marriage with a foreigner.
According to this legislation, in the event of separation, former spouses may be registered as parents of the child born to a gestational surrogate only when the court has determined that the dissolved marriage is not fictitious. This avoids marriages formed for fraudulent purposes. If during the surrogate's pregnancy, one of the spouses dies or loses his or her citizenship, consent is then needed from the gestational surrogate in order for the couple to be recognized as the parents of the child. The same parameter is also used in the case of a single woman's loss of citizenship status.
According to Vyacheslav Volodin, chairman of the State Duma, this reform aims to prevent child trafficking and exploitation as well as organ trafficking.

Intended Parent requirements

Intended parents must supply the genetic material for embryo creation. Access to the program is allowed only to heterosexual couples where it is preferred that the woman of the couple certify her inability to conceive naturally (this condition can be waived in certain cases). From 2022, only married Russian citizens (or from other countries but married to a Russian citizen) and single Russian women unable to bear children for medical reasons are able to use surrogacy services under the new law.
